CONCERNING
PROVISIONS AND PROCEDURES FOR TECHNICAL VERIFICATION/SURVEILLANCE OF THE EXPORT OF CERTAIN PRODUCTS OF FORESTRY INDUSTRY BY SURVEYORS

Considering:
- a. that, in order to implement the provisions in Article 9 paragraph (7) of Regulation of the Minister of Trade No. 09/M-DAG/PER/2/2007 dated February 14, 2007 concerning Export Provisions of Forestry Industry Products, it is necessary to regulate provisions and procedures for technical verification/surveillance of the export of certain products of forestry industry by surveyors;
- b. that based on the considerations as describe in paragraph a above, it is necessary to stipulate a regulation of the Director General of Foreign Trade;
In view of:
- 1. Presidential Regulation No. 10/2005 on Echelon One Organizational Units and Tasks of State Ministries as has already been amended several times and latest by Presidential Regulation No. 63/2005;
- 2. Presidential Decree No. 34/M/2005 on Appointment of First-Echelon Officials within the Ministry of Trade;
- 3. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on the Organization and Working Arrangement of the Ministry of Trade as has already been amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/12/2005;
- 4. Regulation of the Minister of Trade No. 14/M-DAG/PER/3/2006 dated March 29, 2006 on Provisions and Procedures for the Issuance of Business License of Survey Service;
- 5. Regulation of the Minister of Trade No. 09/M-DAG/PER/2/2007 dated February 14, 2007 on Provisions on the Export of Forestry Industry Products;
HAS DECIDED:
To stipulate:
THE REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON PROVISIONS AND PROCEDURES FOR TECHNICAL VERIFICATION/SURVEILLANCE OF THE EXPORT OF CERTAIN PRODUCTS OF FORESTRY INDUSTRY BY SURVEYORS.
Article 1
Referred to in this regulation as:
- 1. Certain forestry-industry products are the forestry industry products subsumed into tariff headings HS 4407, HS 4409, Ex HS 4412 (especially for laminated wood), HS 4415, HS 4418 and EX HS 9406 (especially for wooden pre-fabricated building).
- 2. Surveyors are business entities securing Surveyor Service Business License (SIUJS) issued by the Ministry of Trade and stipulated by the Minister of Trade to undertake technical verification/surveillance of the export of certain forestry industry products.
Article 2
Surveyors must apply technical verification/surveillance to the export of the certain forestry industry products as intended in Article 1 point 1.
Article 3
(1) Approved Exporters of Forestry Industry Products (ETPIK) planning to export the certain forestry industry products are obliged to submit Application for Inspection of Exported Goods (PPBE) to the surveyors.
(2) The submitted PPBE as meant in paragraph (1) uses the format mentioned in the attachment to this regulation by enclosing:
- a. Copy of recognition to ETPIK (for the first submitted PPBE);
- b. Copy of Packing List (P/L);
- c. Copy of Invoice; and
- d. Copy of Ratification of Endorsement from the Forestry Industry Revitalization Board (BRIK).
(3) PPBE as meant in paragraph (1) is submitted in not later than 3 (three) days before the date of inspection of goods to the surveyors.
Article 4
Activities executed by the surveyors in the framework of the technical verification/surveillance of the certain forestry industry products are:
- a. Administrative verification, covering:
- 1. Legitimacy of document of ETPIK;
- 2. Legitimacy of Endorsement Ratification Document.
- b. Physical verification, covering:
- 1. Quantity, kind, brand and number of package;
- 2. Quantity of goods;
- 3. Kind of timber;
- 4. The technical criteria as regulated in Attachment II to Regulation of the Minister of Trade No. 09/M-DAG/PER/2/2007 on Provisions on the Export of Forestry Industry Products;
- 5. Conformance of Tariff Headings/HS Numbers;
- 6. Putting Identity of Surveyors on the package already inspected;
- 7. Supervising the loading into container, if the shipment uses container; and
- 8. Installing seal at container if all goods in the container are inspected by the surveyor.
Article 5
(1) Result of the technical verification/surveillance of the export of certain forestry industry products by the surveyors are mentioned in the form of:
- a. Surveyor report (LS) in the case of the inspected forestry-industry products being suitable to the provisions in force; or
- b. Inspection Report (LHP) in the case of the inspected forestry-industry products being not suitable to the provisions in force.
(2) LS or LSP is issued by surveyors in not later than one day after the date of the inspection and/or supervision over the loading into container is completed.
Article 6
ETPIK can raise objection in writing to the Director General of Foreign Trade in the case of surveyors not issuing LS/LHP in the period as intended in Article 5 paragraph (1).
Article 7
Every LS only can be used as customs complementary document required for registration of the one number of Export Declaration (PEB) or Customs Declaration of Single Administrative Document (PP SAD) for Customs and Excise Service Offices that had already applied it.
Article 8
Copy of PEB or PP SAD must be conveyed by ETPIK ro surveyors in not later than 2 (two) days after securing loading approval.
Article 9
(1) Surveyors are obliged to report results of technical verification/surveillance of the export of certain forestry industry products to the Director General of Foreign Trade, Ministry of Trade with a copy made available to the Director General of Agro and Chemical Industries, Ministry of Industry and Director General of Forestry Production Development, Ministry of Forestry in the form of hard copy and electronic data.
(2) The report as meant in paragraph (1) must be conveyed by surveyors in not later than the 15th of the ensuing month.
Article 10
Violation of the provision as intended in Article 9 is subjected to sanction in the form of revocation of right to receive service fee of verification executed in the not reported month.
Article 11
With the enforcement of this regulation, Regulation of the Director General of Foreign Trade No. 02/DAGLU/PER/3/2006 on Procedures for Technical Verification/Surveillance of the Export of Certain Timber Products by Surveyors is revoked and declared null and void.
The regulation comes into force two months as from the date of stipulation.
